Terms of Service

Last updated: October 17, 2026

These terms govern grafizum.com, the Grafizum Command Center dashboard, its phone app and its MCP connections. By creating an account, connecting a client or installing the app, you agree to them. An individual agreement can add to these terms; where the two differ, the individual agreement wins.

1. Who we are, and what these terms cover

These terms are between you (“you”) and Grafizum, Switzerland (“Grafizum”, “we”, “us”). They cover the website, the dashboard, the phone app and MCP access.

2. Your account

Accounts are for people aged 18 or over. Give accurate details, keep your password and any agent keys to yourself, and tell us promptly if you think someone else has access. What happens under your account is your responsibility, including what the agents and connections you authorise do.

One account belongs to one person. Keep your credentials to yourself and do not share them.

3. Closed beta

The Command Center is in a closed beta: accounts open by invitation, and some panels are still being built. The beta is free of charge.

During the beta we may change, suspend or retire features. Where a change would remove something you rely on, we give reasonable notice and a way to export your data. A beta is not a promise that a feature will still exist tomorrow.

4. Plans, prices and VAT

Paid plans are sold by Polar (polar.sh) as merchant of record, not by us. Polar is the seller on the invoice, charges the price shown at checkout and is responsible for the taxes it applies to that purchase; it also handles refunds and chargebacks. Our part is providing the software.

The pricing page is not an offer until a plan is actually buyable. The checkout shows the price in the currency the pricing page quoted you (USD, or your local currency such as EUR, CHF or GBP), whether tax is included, the length of the free trial, the date of the first charge, the billing interval and how to cancel — before you confirm. A trial with a card on file converts automatically at the end of the trial unless you cancel before then.

We will not start charging an existing free account without your explicit confirmation.

Price changes are announced at least 30 days in advance, and you may cancel before they take effect.

5. Acceptable use

You agree not to:

  • break the law, infringe someone's rights, or store content you have no right to store;
  • attack the service: scanning, probing, flooding, evading rate limits, or trying to reach another tenant's data;
  • resell, sublicense or white-label the service without a written agreement;
  • reverse-engineer the service except where the law allows it;
  • upload malware, or use the service to send spam;
  • use an agent or connection to do something you could not do yourself under these terms.

We may suspend an account that endangers the service or other customers, and we tell you why. Serious or repeated breaches can end the contract.

6. Your content, our software

You own your project content: projects, tasks, notes, documents and the data you bring with you. You give us the licence we need to store, process and display it so that the service works — nothing more, and nothing that survives the end of the contract beyond backups and legal retention.

We own the service: its code, design, templates, documentation, the Grafizum name and marks, and the example concepts shown on this website. Third-party components such as fonts and libraries stay under their own licences.

7. Connected services and agents

The dashboard can connect to GitHub and to AI clients through MCP. You choose what to connect and which scopes to grant; we act on your instruction and within the rules you set.

GitHub and the AI client are third parties with their own terms and their own outages. We are not responsible for what they do with data you send them, and we cannot make their service available. If an integration changes or disappears, we tell you as soon as we know.

Tokens you add are encrypted at rest and never displayed again. Revoking a connection stops new requests; it does not retract data the other side already received.

AI output can be wrong. You remain responsible for reviewing what an agent does before you rely on it, ship it or bill someone for it.

8. Fees and payment

Paid plans are billed by Polar as merchant of record. We never receive or store your card details; the payment method, the invoice and the receipts come from Polar, and Polar's terms apply to the payment itself. If a payment fails, Polar retries, and we keep the workspace available for a short grace period before the plan falls back to the free limits.

9. Confidentiality

We treat non-public information exchanged with you — business ideas, drafts, credentials, project content — as confidential, while you use the service and after it ends. The duty does not cover information that is public or that we must disclose by law.

10. Data protection

Each party follows the data protection law that applies to it. Our own processing is described in the Privacy Policy. Where we process personal data on your behalf, we do so on your instructions, and we provide the processing terms FADP Art. 9 requires — write to [email protected] and we send them, free of charge, before you send us other people's data.

11. Warranty and liability

We provide the service with professional care. The beta is provided as it is, without a promise that it is error-free or uninterrupted.

To the extent the law allows, our liability for direct damage is limited to the fees you paid for the service in the twelve months before the event. We are not liable for indirect damage, lost profit, lost data or reputational harm.

Nothing here excludes liability that cannot be excluded by law — in particular for intent or gross negligence, for personal injury, or under product liability law.

12. Term and termination

The beta runs while your account exists. A paid subscription runs for the billing period and renews until you cancel. You cancel in the Polar customer portal, linked from the dashboard and from your Polar receipt; cancellation takes effect at the end of the current period, and you keep access until then.

We may terminate for serious breach, for non-payment, or if we discontinue the service with reasonable notice. After termination you can export your content for 30 days, then we delete it as described in the Privacy Policy.

13. Changes to these terms

We may update these terms when the service changes. Material changes are announced in the dashboard or by email at least 30 days before they take effect, and you may cancel before then. The version on this page, with its date, is the one that applies.

14. Force majeure

Neither party is liable for delay or failure caused by circumstances beyond reasonable control — natural disasters, pandemics, power or network failures, or an outage at a provider we depend on.

15. Governing law and jurisdiction

These terms and all agreements with Grafizum are governed by Swiss law, excluding its conflict-of-law rules. Subject to mandatory provisions, the courts at Grafizum's registered office in Switzerland have exclusive jurisdiction.

The purchase of a paid plan is a separate contract with Polar as seller. Polar's own terms and refund policy apply to that purchase; these terms govern your use of the software and anything we do for you directly. If the two conflict about a payment, Polar's terms decide; about the software, these terms do.

If you are a consumer, this does not take away the mandatory protections of the law of the country where you live. A consumer in the EU or EEA keeps, in particular, the rights that law gives and cannot waive — including a statutory withdrawal right where one exists.

Swiss law itself gives consumers no general right to withdraw from distance contracts. We do not pretend otherwise, and we do not offer a right we would then have to refuse.

A withdrawal or refund request for a paid plan goes to Polar as your seller, through the link on your receipt or in the Polar customer portal. We cannot grant or refuse it on Polar's behalf.
